Don Allaway - Partner

Don Allaway is a partner in the firm's Corporate Department, where he has practised since joining the firm in 2000. Prior to that he practised in Durban for many years as a Corporate Lawyer.

Some of the matters in which Don has represented clients are, the transfer of the Professional Provident Society's insurance business to a Life Insurance Company, participation in the Pebble Bed Modular Reactor Project, the Initial Land Assembly for the Point Waterfront Development in Durban, the development of the Durban and Sandton Hilton Hotels and the development of the Zimbali Coastal Forest Estate. Don also represented Idion in its successful defence of a hostile take over bid initiated by Datamirror, a Canadian Company. He is currently representing a voluntary trading organisation with more than 250 outlets in South Africa and the United Kingdom which is the target of two competing take over bids initiated by subsidiaries of JSE listed companies. He also represents Bowman Gilfillan in respect of the development of the property it will occupy in the Sandton CBD.

Don is a fellow of the Society of Arbitrators and has lectured extensively at the invitation of professional organisations including the International Bar Association, the Association of Law Societies and to Accountants, Architects, Engineers and Quantity Surveyors.

Tim Gordon-Grant - Partner

Tim joined Bowman Gilfillan in 1982 and was appointed as a partner of the firm in 1988 and as Head of the Litigation Department in 2001. During this time Tim has represented and litigated on behalf of various large corporate clients of the firm, many of which have been matters involving high public profile hearings and arbitrations. His expertise and assistance are sought when strategic advice is required in liability situations, predominantly in the fields of corporate, commercial, banking, insurance and insolvency law. He has particular expertise in litigation dealing with the JSE listing requirements and the SRP rules. Tim also offers clients assistance with corporate recoveries and general litigation matters and enjoys a successful arbitration practice. Tim has provided his assistance and time to the Department of Justice and Constitutional Development by acting as a Commissioner of the Small Claims Court.

Adam Harris - Partner

Adam Harris is a Director of Bowman Gilfillan and specialises in insolvency, business restructuring and related fields. He is a Director of INSOL, the international body which represents Insolvency and business restructuring professionals worldwide, as also a national Councilor of AIPSA (the Association of Insolvency Practitioners of Southern Africa). Adam also edits the AIPSA newsletter. He previously chaired the Law Society of South Africa Insolvency Committee. In the course of his practice, Adam represents lenders and creditors and other institutions such as professional indemnity insurers, as well as insolvency practitioners in various aspects relating to the administration of insolvent estates and winding-up of companies. Adam has attended to some of the leading cases on different aspects of insolvency such as the constitutionality of interrogations, impeachable transactions, procedural aspects of liquidation applications and liquidators’ remuneration. He is one of the co-authors of the latest edition of Mars, a leading insolvency text in South Africa (shortly to be published).

Paul is a partner in the corporate department in our Cape Town office. He regularly acts as attorney and adviser to one of the leading sports agencies, World Artists (SA) (Pty) Ltd. World Artists represents 70 professional rugby players, of which 18 are Springbok players. Paul also acts for these players in contractual and sponsorship matters. Paul’s work entails, advising and drafting in relation to players’ contracts, sponsorships and the like. Paul also actively advises on the professional sports tournaments.

Lastly, Paul represents a football sports agency which represent many professional South African football players.

He specialises in commercial litigation, financial services and tax litigation, insolvency and bankruptcy law, cross-border insolvency, and IT-related litigation. He is a member of the Insolvency Practitioners of South Africa and has advised creditors, financial institutions and liquidators in some of the major insolvencies which have arisen in South Africa over the last decade. James also has a keen interest in information technology and computer law and advises the firm on IT strategy.

Claire Van Zuylen - Partner

Claire devotes most of her time to Insolvency and Work-outs. She holds BA and LLB degrees (University of Natal, Durban) together with a Post Graduate Diploma in Tax (University of Natal, Durban) and a certificate in Advanced Corporate Law and Securities (UNISA). She has specialised in insolvency from both a litigation and commercial perspective since 1998 and has represented numerous investment and commercial banks, trust companies, liquidators and trustees, and major creditors both in South Africa and overseas.

She is the author of the South Africa chapter in "Insolvency and Restructuring 2004" (Business Law Research), an international publication setting out and comparing aspects of insolvency in 37 jurisdictions worldwide. She is a member of the Banking Lawyers Association of South Africa. She also practices in general commercial transactions, the medical schemes industry, the long and short term insurance, financial services and banking industries.

Peter Whelan - Partner

Peter joined Bowman Gilfillan in 1980 and was admitted as a partner in 1983. He specialises in commercial litigation generally, but with specific emphasis on insolvency related matters, workouts and corporate restructuring. He has advised the majority of the country’s financial institutions and has also represented numerous insolvency practitioners and creditors. He has been involved in a number of cross-border insolvency matters involving jurisdictions as diverse as the Isle of Man, the Republic of Ireland, Namibia, Portugal, Uruguay and Japan. Peter also practices in the field of sports law and has represented sports unions and individual sports men and women and their agents in, amongst other things, contract negotiation, disciplinary enquiries and sponsorship agreements. He is a member of several committees, institutions and public bodies, both professional and non professional and holds a number of directorships and is legal advisor to various charitable foundations and trusts.
